Do you have to file every year first?
The IRS will not consider a plan while any return is missing. A late return goes to the same place as an on-time return, or to the address on your notice. It takes about 6 weeks to process, per the IRS page on filing past due tax returns.
If you lost your W-2s or 1099s, Form 4506-T gets you a wage and income transcript. If the IRS already filed a return for you, you have 90 days to file your own or petition Tax Court. Your tax pro gathers the records and files the missing years with you.
Can several years go into one plan?
Every year you owe goes into one plan with one monthly payment. The $50,000 online limit counts all the years together, with penalties and interest. Each year keeps its own 10-year collection clock, per Topic 202.
Late filing costs more than late payment. The late-filing penalty is 5% a month, up to 25%, per Topic 653. For returns due in 2026, filing over 60 days late brings a minimum of $525 or the full tax, whichever is less.
What changes when the total passes $50,000?
Above $50,000, the online form is closed. You apply by mail or phone and send Form 433-F, a list of your income, bills and assets. The full rules are on payment plans over $50,000.
Your tax pro fills out Form 433-F with you so the numbers support a payment you can afford.
What if the years add up to more than you can pay?
Some balances are too big for any monthly payment. If a plan would leave you short on basics, a hardship pause or a settlement for less may fit better. Both are covered on what to do if you can't pay.
A Low Income Taxpayer Clinic helps people with low income for free or a small fee. Your tax pro checks which option costs you least and starts it on the call.
Frequently asked questions
Will the IRS do a payment plan for back taxes?
Yes, once every required return is filed. All your years can go into one plan. Online works if the total is $50,000 or less.
How many years will the IRS give you to pay back taxes?
Generally up to 10 years from the date each tax was assessed. Each year has its own clock, so older years run out sooner.
What do I do if I have unfiled tax returns?
File them, even if you cannot pay yet. A wage and income transcript replaces lost W-2s or 1099s. A licensed tax pro files them with you and then sets up the plan.
Does the IRS forgive unfiled taxes?
No. If you do not file, the IRS can file a return for you without your deductions and send a bill. You then have 90 days to file your own return.
